Improving Financial Security in the Context of the Environmental Liability Directive

This report prepared by Valerie Fogleman with assistance of Ecologic Institute examines and analyses financial security for liabilities under the Environmental Liability Directive (ELD) in Member States in which it is voluntary and those in which it is mandatory (the Czech Republic, Ireland, Portugal, Slovakia and Spain). It focuses on insurance because the vast majority of Member States have not introduced mandatory financial security for ELD liabilities.

The report finds that insurance for ELD liabilities is not generally available to most small and medium sized, as well as many large, operators in many Member States. It concludes that effective implementation of the ELD cannot occur in the absence of insurance for liabilities under it. It therefore recommends that the Commission and Member States carry out the measures to increase the availability of, and demand for, insurance for ELD liabilities.
