In light of the agreed expansion of European emissions trading (inter alia the gradual inclusion of maritime transport and the introduction of the EU ETS 2), the study contains an analysis of the current sanctions regime in emissions trading. The fundamental amendment to the TEHG brought about by the TEHG EU Alignment Act 2024 has already been taken into account. Proposals for a more effective sanctions regime are put forward, relating both the enforcement of existing regulations and reforms of these regulations. The study focuses on administrative offence law. The report was prepared by a team from Ecologic Institute on behalf of the German Federal Environment Agency.

The recommendations for improvement relate to the following areas:

  • Administrative fines against companies that delegate tasks below management level, 
  • Distinguishing between intent and negligence and (alleged) errors of law in a particularly technical and complex area, 
  • Involvement of external verifiers, 
  • Mitigating and aggravating factors in the assessment of administrative fines, 
  • Introduction of a catalogue of administrative fines, 
  • Introduction of guidelines for refraining from prosecution on factual and other grounds, 
  • Introduction of thresholds for initiating proceedings to impose excess emissions penalties, 
  • Cases with international implications.
