Moorland protection projects can already be implemented within the current legal framework. However, efficient implementation requires the authorities to make consistent use of the existing scope for decision-making.
Moors store carbon, secure the water balance and provide a habitat for rare species. However, legal requirements often seem to stand in the way of peatland protection.
This background paper clarifies the scope for decision-making that the authorities have, for example in the planning and approval of rewetting measures, particularly in planning and regulatory law. Conflicting objectives in nature conservation law, such as special species protection, are also addressed. The author explains which procedures are possible, what is important for approval and how existing leeway can be used in the interests of moorland protection.
The publication is aimed at employees of public authorities as well as private project sponsors. The background paper is intended to help reduce legal uncertainties, plan projects with foresight and make decision-making processes more efficient.
Background
The background paper was produced as part of the MoorNet research and development project. MoorNet supports the implementation of the National Moorland Protection Strategy and networks the moorland protection stakeholders in Germany. The author Felix Dengler is a fully qualified lawyer and Fellow at Ecologic Institute. His work focuses on nature conservation, climate adaptation and water law.
