On 17 December 2003, the German Cabinet adopted the Emissions Trading Act and the Ordinance implementing Directive 2003/87/EC for Installations pursuant to Federal Emissions Protection, which represents a first comprehensive draft of the legal framework for an emissions trading system in Germany. They form the basis of the recent decision adopted by the Federal Bundestag on 12 March 2004 regarding the Emissions Trading Act. Contrary to the Cabinet decision the Emissions Trading Act now provides for enforcement on the Federal level without involvement of the Federal States. Read more

Institutional Interaction to Address Greenhouse Gas Emissions from International Transport

ICAO, IMO and the Kyoto Protocol
In response to Article 2.2 of the Kyoto Protocol, the International Maritime Organisation (IMO) and the International Civil Aviation Organisation (ICAO) have begun to consider greenhouse gas (GHG) emissions from international aviation and shipping. However, neither ICAO nor IMO have taken any effective action on the issue yet and progress can be characterised as slow. But there are options for furthering the progress within ICAO and IMO. National Allocation Plan for the European Emissions Trading System

In order to comply with the European directive on emissions trading  the Member States have to establish so-called national allocation plans within a very short time frame which state the total number of allowances to be allocated and the rules of allocation. To establish such a plan in Germany, it is necessary to conduct an extensive data collection in order to understand the emissions of each installation which is covered by the directive. Read more

Legal Framework for a National Emissions Trading Scheme

June 2003 to December 2004
In order to implement its obligations to reduce greenhouse gas emissions, as required under the Kyoto Protocol, the European Community elaborated a directive establishing a community-wide greenhouse gas trading system. Ecologic has been commissioned by the German Federal Ministry for the Environmemnt to analyse the legal framework for implementing the directive in Germany and also to draft the implementing legislation. In addition Ecologic develops provisions for the implementation of the flexible Mechanisms under the Kyoto Protocol. Read more

Air Pollution Abatement Planning

The workshop aims at continuing and intensifying the process of an international exchange of experiences with the on-going activities which was started by a workshop in September 2001 in Bruges. It will focus on the exchange of information regarding experiences in the field of air pollution abatement measures - both their planning (drawing up action plans according to art. 7 (3) and preparation of plans or programmes according to art. 8 (3) of the Framework Directive) and their implementation. The workshop will serve as a forum for exchanging experiences on the national implementation of the EU air quality directives with emphasis on air pollution abatement measures. Read more
